2 common but preventable reasons for workers’ comp denials

On Behalf of | Feb 16, 2023 | Workers' Compensation

Many workers’ comp claims proceed without a single hitch. Other times, employees are shocked to receive a notice informing them that their claim was denied.

When you understand why some denials occur, you can take steps to prevent them from happening to you. Let’s look at two common reasons for denied claims.

You missed a deadline

Although you have rights as an injured worker, there are time constraints. A missed deadline is a leading reason for workers’ compensation claim denials. Under New Jersey law, you have 14 to 90 days to report the injury to your superiors and two years to submit your claim.

The Department of Labor and Workforce Development oversees the state workers’ comp program. If the department asks you for additional information, you must submit it by the designated deadline to help prevent a denial.

You failed to follow medical orders

You must see a doctor for any workplace injuries you suffer, but that is not the end of your medical responsibility. The physician will create a treatment plan that encourages as speedy and complete a recovery as possible. If you fail to follow the treatment plan, you could lose your workers’ compensation benefits.

Always seek a medical opinion after a workplace accident to build a sturdy foundation for your claim. Be sure to follow all instructions the doctor gives you.

You can avoid having your claim denied by partnering with an experienced legal representative. If your work injury is severe enough to pose the risk of long-term or permanent disability, you cannot afford to make any errors with your claim.
