What Are Your Rights When You Are Injured On The Job?

Every employer in New Jersey is required to have workers’ compensation insurance.

You have the right to receive:

  1. Adequate medical treatment with no limitation on the length of the treatment and with no co-pays or deductibles. In other words, you will have no out-of-pocket expenses.
  2. If you are out of work over seven (7) days, you are entitled to receive 70% of your salary or wages up to a maximum amount depending on the year of your injury. This seven (7) days period is referred to as a “waiting period” and they do not need to be consecutive.
  3. Money damages based on the degree or extent of your injury.
  4. In some cases, you can receive weekly payments for the rest of your life if you are considered to be “totally disabled.”
